>> THIS MORNING I JUST HAVE ONE ITEM FOR YOU WHICH IS THE AMENDED JOINT POWERS BOARD AGREEMENT FOR THE SOUTH CENTRAL COMMUNITY-BASED INITIATIVE.

EVERY YEAR THIS BOARD APPROVES OUR JOINT POWERS BOARD AGREEMENT.

BUT THIS YEAR WE ARE MAKING SOME SLIGHT ADJUSTMENTS.

THE MOST SIGNIFICANT CHANGES THAT PREVIOUSLY THE AGREEMENT GAVE THE JOINT POWERS BOARD THE ABILITY TO USE THE STATE'S FUNDING AND OUR TIME AND RESOURCES TO LOOK AT THINGS THAT IMPACT THOSE WITH SEVERE AND PERSISTENT MENTAL ILLNESS SO THINGS LIKE OUR CLUBHOUSE AND CRISIS FUNDING, SOME OF THOSE MOBILE CRISIS SERVICES.

WE ARE ASKING AT THIS TIME THAT THE AGREEMENT BE AMENDED TO INCLUDE PEOPLE WITH SERIOUS MENTAL ILLNESS AND YOUTH WITH SERIOUS EMOTIONAL DISORDERS.

THOSE ARE JUST A COUPLE OF LANGUAGE CHANGES, I BELIEVE, IN TWO SPOTS ON THE AGREEMENT.

MOSTLY THIS CHANGE IS BEING REQUESTED BECAUSE WE ARE FINDING THAT WE HAVE VERY FEW OPTIONS FOR YOUTH IN OUR REGION.

IT'S A STATEWIDE ISSUE.

THERE'S NO PLACEMENTS, THERE'S NO CRISIS SERVICES AVAILABLE.

THIS WOULD GIVE US THE ABILITY TO FORM A WORK GROUP FOR CHILDREN'S CONTINUUM OF CARE, A WORK GROUP THAT WOULD BE MADE UP OF SUPERVISORS IN THE REGION, AND THEN GIVE THE JOINT POWERS BOARD THE ABILITY TO MAKE SOME DECISIONS AROUND ANY REGIONAL MOVEMENT THAT WE WOULD BE REQUESTING.

DO YOU WANT TO ADD ONTO WHAT YOU HAD MAYBE MENTIONED AT THAT, KASEY?

>> WELL, I THINK AT THAT MEETING, SOME OF THE PRIMARY ISSUES DISCUSSED WERE AGAIN, THAT [INAUDIBLE] I REFORM THAT WE'VE TALKED ABOUT HERE AND CONCERNS TO DO WITH THAT.

I HAD SHARED CONCERNS ABOUT THE LACK OF PLACEMENT OPTIONS FOR ADULTS WITH MENTAL ILLNESS AS WELL AS CHILDREN WHO ARE STRUGGLING, THINKING ABOUT THAT CHILDREN'S CONTINUUM OF CARE THAT WE'RE IN NEED OF.

THEN I HAD JUST PROVIDED A COUPLE OF UPDATES ABOUT OUR WORK REGARDING ACTIVELY RECRUITING A DIVERSE WORKFORCE, HIRING COMMUNITY HEALTH WORKERS, AND OUR PARTNERSHIP WITH [INAUDIBLE] FOR THE FOOD INSECURITY PROGRAM.

ONE ITEM FROM PUBLIC WORKS TODAY.

THE ITEM IS TO CONSIDER FILING ACCEPTANCE FOR PROJECT SP 52621028.

IF YOU RECALL, THIS PROJECT INVOLVED WORK THAT WAS COMPLETED LATER IN NOVEMBER 2020 TO TEMPORARILY STABILIZE THE COUNTY ROAD 21 EMBANKMENT ALONG THE MINNESOTA RIVER THAT WAS DAMAGED FROM FLOODING IN JUNE OF 2020.

THIS WORK OCCURRED ON 21 JUST EAST OF THE COUNTY ROAD 14, 21 INTERSECTION.

AGAIN, THIS WAS AN EMERGENCY REPAIR PROJECT THAT ALLOWED US TO REOPEN COUNTY ROAD 21 TO BOTH TRAVEL LANES AND IT ALSO BUYS US TIME TO DEVELOP PLANS, SPECIFICATIONS, AND THE ENVIRONMENTAL PERMITTING THAT'S REQUIRED TO DEVELOP THE PERMANENT REPAIR WORK PLAN.

WE'RE ANTICIPATING THAT COULD POTENTIALLY OCCUR LATER THIS YEAR OR INTO 2023.

WE'VE RUN INTO SOME UNIQUE DESIGN CHALLENGES THAT WE'RE WORKING THROUGH AND SO THAT'S PUSHING THAT OUT.

BUT THIS TEMPORARY EMERGENCY REPAIR PROJECT IS WORKING VERY WELL AND BUYS US THAT TIME TO FINISH THAT DESIGN WORK.

THIS PROJECT WAS FUNDED 100 PERCENT BY FEDERAL HIGHWAY EMERGENCY RELIEF FUNDING.

FINAL VALUE OF THE CONTRACT WAS $293,084.25.

[INAUDIBLE] WAS THE PRIME CONTRACTOR, DID AN EXCELLENT JOB.

THERE WAS A QUESTION ABOUT WHY DID WE CUT TREES DOWN ALONG COUNTY ROAD 21 WHERE WE DID SOME OF THIS EMERGENCY WORK.

WE CUT DOWN TREES IN ANTICIPATION OF POTENTIALLY THE PROJECT STARTING IN 2022 HERE.

AS PART OF UTILIZING FEDERAL FUNDS, THERE'S CERTAIN ENDANGERED SPECIES THAT WE HAVE TO TRY TO AVOID AND MITIGATE AND SO THERE'S THE NORTHERN LONG-EARED BAT, WHICH IS A THREATENED ENDANGERED SPECIES, AND OF COURSE WE HAVE BALD EAGLES THAT LIKE TO NEST IN THE RIVER VALLEY.

PART OF THE WAY THAT YOU MITIGATE ANY IMPACT TO THE NORTHERN LONG-EARED BAT IS TO CUT DOWN TREES DURING FROM LATE FALL INTO LATE WINTER, VERY EARLY SPRING BECAUSE THE BATS ARE HIBERNATING TYPICALLY IN CAVES AND ARE NOT IN THE TREES.

IF WE WERE PROPOSING TO CUT DOWN TREES DURING PRIME BAT SEASON, JUNE, JULY, AUGUST,

THE LEVEL OF PERMITTING AND COORDINATION WORK AND APPROVAL FROM THE FEDERAL GOVERNMENT GETS MUCH MORE ARDUOUS.

WE WERE TRYING TO BE PROACTIVE, CUT THOSE TREES DOWN EARLY.

THEY WILL EVENTUALLY BE REMOVED WHEN WE DO THE PERMANENT REPAIR PROJECT.

OUR CLASSIFICATION AND COMPENSATION STUDY CONTRACT.

TODAY, MY ITEM IS THE CLASSIFICATION AND COMPENSATION STUDY ACCORDING TO BEST PRACTICES, WHICH IS EVERY 10 YEARS AND CURRENT ECONOMIC CONDITIONS, WAGE GROWTH, INFLATION, OTHER CHANGES IN THE EMPLOYMENT ENVIRONMENT.

THOSE THINGS SUGGESTS THAT IT'S TIME FOR US TO DO A CLASSIFICATION AND COMPENSATION STUDY.

THERE WILL BE TWO GOALS OF THE STUDY: THE FIRST ONE IS TO MAKE SURE THAT WE'RE PAYING COUNTY EMPLOYEES FAIRLY AND EQUITABLY AND IN ACCORDANCE WITH THE FAIR LABOR STANDARDS ACT, AND THE SECOND GOAL IS TO MAKE SURE WE ARE DOING THAT AND BEING GOOD STEWARDS OF TAXPAYER DOLLARS AT THE SAME TIME.

THE RESULT OF THE STUDY WILL BE A RECOMMENDATION, LIKELY A SET OF OPTIONS FOR IMPLEMENTING THE FINDINGS OF THE STUDY.

BUT TODAY I'M ASKING FOR APPROVAL FOR A CONTRACT WITH ARTHUR J. GALLAGHER AND COMPANY IN THE AMOUNT OF $52,000 TO SERVE AS OUR CONSULTANT IN THIS STUDY.

>> ONE OF THE REASONS I'M REQUESTING THIS CONTRACT WITH ARTHUR J. GALLAGHER TODAY IS BECAUSE WE HAVE USED THEM IN THE PAST AND THEY HAVE HISTORICALLY DONE A VERY GOOD JOB WORKING WITH ORGANIZATIONS IN THE PUBLIC SECTOR TO MAKE SURE THAT THERE IS A BALANCE THERE BETWEEN MAKING SURE EMPLOYEES ARE COMPENSATED FAIRLY AND KEEPING IN MIND THAT WE WANT TO BE WISE WITH OUR DECISIONS BECAUSE WE ARE WORKING WITH THE TAXPAYER DOLLARS.

THAT'S EASY TO UNDERSTAND AND EXPLAIN AND GET BUYING FROM STAFF AND SUPERVISORS AS OPPOSED TO SOME SYSTEMS THAT ARE VERY COMPLEX.

I AM IN FRONT OF YOU TODAY FOR THE CONSIDERATION OF THE NORTH MANKATO HHS INTERIOR REMODEL.

JUST TO NOTE ON THE EXTERIOR PORTION OF THE BUILDING WAS REMODELED IN 2020, SO THIS IS GOING INTO THE INTERIOR REMODEL.

THE PURPOSE OF THE REMODELS TO ADDRESS SAFETY AND SECURITY CONCERNS, ADA REQUIREMENTS, AND OVERALL BUILDING EFFICIENCIES.

WITHIN YOUR BLUE AGENDA FOLDER, YOU DID RECEIVE ABOUT BID TABULATIONS PRIOR TO THE MEETING.

THERE ARE TWO DOCUMENTS WITH EACH IDENTIFYING THE BID AMOUNTS FROM CONTRACTORS.

[NOISE] BIDS WERE OPENED ON JANUARY 20TH OF 2022 IN THE BOARDROOM AND THEY ARE CONSIDERED FAVORABLE.

A COUPLE OF ITEMS I WOULD LIKE TO NOTE THAT WE DID RECEIVE MULTIPLE BIDS IN ALL CATEGORIES, EXCEPT FOR CATEGORY 8 WHICH IS FIRE SUPPRESSION, AND CATEGORY OF 14 WHICH IS SPECIALTIES MATERIAL ONLY, WHICH DOESN'T SEEM TO BE UNCOMMON.

I ALSO WOULD LIKE TO NOTE THAT WITHIN YOUR DOCUMENT THAT IS LIKE THIS, YOU WILL NOTICE THAT THERE IS NOT A CATEGORY 11 IN THE DOCUMENT THAT IS IDENTIFIED LIKE THIS.

THAT IS THE CATEGORY 11 AND THOSE ARE SPECIFIC TO THE CURVE CONTROLS, WHERE THE OWNER REQUIREMENTS THAT ITEMS AT THE COUNTY WILL BE TAKING CARE OF.

THESE TYPICALLY INCLUDE LIKE FURNITURE ITEMS, APPLIANCES, SIGNAGE, AND TECHNOLOGY EQUIPMENT, WHICH WOULD BE LIKE THE WHITE NOISE, INTERNET, ITEMS LIKE THAT, THE DOOR READERS AND EVERYTHING OF THAT NATURE, AND THEN ANY HAZARDOUS MATERIAL WITHIN THE BUILDING.

THE REASON I BRING THAT UP, JUST WANTED TO MAKE SURE THAT ALL THE CATEGORIES THAT YOU DID RECEIVE IN THIS DOCUMENT, THOSE ARE PRETTY EXACT AS FAR AS THE BIDS COMING IN.

CATEGORY 11 MAYBE A LITTLE BIT MORE FLUID AND THERE MAY BE FEW CHANGES HERE AND THERE DEPENDING ON THE NEEDS AND THE INFORMATION AS IT COMES BACK FROM THE VENDORS.

ISG, THE ENGINEER ON THE PROJECT HAS NOW SUBMITTED THEIR FINAL ACCEPTANCE REPORT TO MY OFFICE.

THE PURPOSE OF TODAY'S HEARING IS FOR THE DRAINAGE AUTHORITY TO CONSIDER ACCEPTING THE ENGINEER'S REPORT TO CLOSE OUT THIS PROJECT.

THE OVERALL SCOPE OF THE PROJECT INCLUDED CLEANING OF THE EXISTING OPEN DITCH, NEW DITCH CONSTRUCTION AROUND THE WETLAND HERE, MORE OPEN DITCH CLEANING AND THEN REPLACEMENT OF TWO CULVERTS, ONE ON THIS PRIVATE DRIVEWAY HERE, AND ONE ON 448TH LANE.

THIS IS JUST ANOTHER QUICK VIEW OF THE PROJECT SCOPE.

THIS IS SHOWING THE AREA WHERE THE NEW DITCH WAS CONSTRUCTED, AND THE AREA WHERE THE SPOILS FROM THAT DITCH WERE PLACED.

THE TIMELINE OF THE PROJECT, BIDS ARE POSTED ON MARCH 12TH OF 2020.

BIDS ARE OPEN ON APRIL 2ND OF 2020.

THE PROJECT WAS AWARDED TO MALINO ON APRIL 28TH.

PRE-CONSTRUCTION MEETING WAS HELD ON JUNE 30TH OF 2020.

CONSTRUCTION STARTED ON OCTOBER 19TH AND WAS COMPLETED ON DECEMBER 18TH.

NOTING HERE THAT THE SUBSTANTIAL COMPLETION DEADLINE OF THEIR CONTRACT WAS NOVEMBER 13TH, SO THEY WERE OVERDUE ON COMPLETION OF THE CONTRACT.

WE'VE GOT JUST A FEW PHOTOS OF CONSTRUCTION.

THIS IS ONE OF THE CULVERTS BEING REPLACED.

THIS IS THE FINAL RIPRAP, THE OUTLET SEEDING.

THE CONTRACT HAS A LIQUIDATED DAMAGES CLAUSE, WHICH AGAIN, MALINO DID NOT MEET.

THE LIQUIDATED DAMAGES ARE THE SUBSTANTIAL COMPLETION DEADLINE OF THEIR CONTRACT.

LIQUIDATED DAMAGES WERE ENFORCED BASED ON THEIR CONTRACT SIZE.

THEY WERE ASSESSED $400 PER DAY, THAT THEY OVERRAN THE CONTRACT FOR A TOTAL OF 35 DAYS.

THEY WERE BACK CHARGED $14,000 THAT WAS REMOVED FROM FINAL PAYMENT OF THE CONTRACT.

THERE'S ALSO A SEEDING REQUIREMENTS IN THE SPEC, THEY ACTUALLY STARTED CONSTRUCTION AFTER THE REQUIRED DATE THAT SEATING IT SHOULD HAVE BEEN COMPLETED, WHICH IS OCTOBER 15TH.

FORTY PERCENT OF ALL THE SEEDING PAYMENT WAS WITHHELD UNTIL THE SEEDING ESTABLISHED AND THEN WAS RELEASED.

THAT WAS BASICALLY WHAT HELD THE CONTRACT OPEN FOR A YEAR,

WAS WAITING FOR THAT SEED FOR ESTABLISH SO WE FLEW THE DRONE ON TWO OCCASIONS IN 2021 TO MONITOR THE STATUS.

THIS IS IN JUNE OF LAST YEAR, AND THEN SEPTEMBER.

WE'VE JUST GOT A FEW SLIDES SHOWING THE PROGRESS AND HOW THAT SEEDING ESTABLISHED.

IT TOOK A LITTLE BIT OF TIME TO ESTABLISH AS THIS WAS A DRY YEAR, BUT IT FINALLY DID IN THE FALL.

AT THIS POINT, ISG FEELS THAT MALINO HAS MET THE REQUIREMENTS OF THE CONTRACT.

WE RECOMMEND ACCEPTING THE WORK.

THE REPAIR COST ESTIMATE AT THE TIME OF APPROVAL WAS $71,390, THE ORIGINAL CONTRACT TO MALINO IS $77,885.

AGAIN, WITH THAT $14,000 IN NEGATIVE CHANGE ORDERS FOR LIQUIDATED DAMAGES, THAT BRINGS THE TOTAL PROJECT COSTS DOWN TO $59,974.65.

TO DATE THEY'VE BEEN PAID 53,797.35.

THERE'S A BALANCE OWED OF $6,177.3.

ISG RECOMMENDS ACCEPTING THE WORK AND PAYING THE REMAINDER OF THE CONTRACT AT THIS TIME.

THERE WAS A CUT OUTPUT DUG IN THERE, AND ROCKS WERE PILED IN THERE AND THE ELEVATION OF THAT IS TOTALLY WRONG, BECAUSE LAST YEAR, SPRING, WHEN THE SNOW MELTED AND EVERYTHING, THERE WAS WATER ALONG THE INSIDE OF THE DIKE IN OUR YARD, SO TWO THINGS THAT WE WOULD LIKE TO SEE HAPPEN IS, THROUGH THE YARD PORTION, THAT THE DIKE GET TAKEN DOWN, SPREAD OUT INTO THE YARD SO THAT IT TAPERS TO THE DITCH, NOT TRAPPED AND THAT PICTURE THAT YOU HAD SHOWN UP THERE, THAT JUNE PICTURE, YOU CAN ACTUALLY SEE WHERE THE WATER HAD BEEN SETTING, TILL ABOUT A YEAR, WE DIDN'T EVEN NEED MOW OR ANYTHING IN THERE, FOR QUITE A WHILE, BECAUSE IT WAS STANDING WATER AND THAT'S WHERE WE PARK OUR VEHICLES AND STUFF WHEN WE COME IN FOR A DUCK SEASON.

CORTER HAS REFERRED TO, AND WE NEEDED TO FIND AN OUTLET TO GET THAT WATER OUT OF THERE SO THAT THAT SPILLWAY WAS RECOMMENDED AS A SOLUTION AND ALL PARTIES AGREE THAT WOULD BE THE BEST WAY TO GO.

THE PURPOSE OF THE ROCK IN THAT SPILLWAY IS TO PREVENT EROSION, IF THERE IS OVERLAND FLOW AND IT IS LOCATED WITHIN THE SIXTEEN-AND-A-HALF FOOT [INAUDIBLE] WHICH IS THE COUNTIES EASEMENT, AND THAT'S ALL THAT I'VE GOT, UNLESS THERE'S ANY OTHER QUESTIONS ON THAT.

BUT IF THERE'S A PROJECT THAT EVERYBODY'S WAITING TO GET CLOSED, THE LIKELIHOOD OF THE PROJECT BEING COMPLETED IS MORE, IT'S GREATER.

HOWEVER, WE DO HAVE FUNDS THAT WERE WITHHELD FROM THEIR FINAL PAYMENT DUE TO THEIR LACK OF PERFORMANCE OR LACK OF TIMELY PERFORMANCE ON THE CONTRACT.

I'M NOT SURE IF ANY OF THAT CAN BE USED TO RESOLVE YOUR CONCERNS, BUT I AM NOT SURE THAT IT'S FAIR TO HOLD THIS CONTRACT OPEN LONGER ON THIS CONTRACTOR AS THEY HAVE CONSTRUCTED THE PROJECT PER PLANS AND SPECIFICATIONS.

HE SAYS, "WELL MAYBE THE DIRT SETTLED AND EVERYTHING AND THAT'S WHY THE WATER IS NOW BEING RETAINED THERE." WELL, WE HAD FOUR OR FIVE INCHES OF WATER IN OUR YARD AND IT STILL WASN'T GOING THROUGH THAT SPILLWAY LAST SPRING.

YOU CAN SEE IN THAT PICTURE WHERE THE GRASS WASN'T EVEN GROWING AND STUFF UNTIL WAY LATER WHEN IT FINALLY CAME IN.

THERE'S NO REASON WHEN IT WAS SUPPOSED TO BE TAPERED BACK IN THE ORIGINAL CONTRACT WHEN WE ISSUED THE PROJECT, WHY SHOULD WE BE SITTING WITH A PUDDLE OF WATER IN OUR YARD?

BASED ON THIS TIMELINE, IT WOULDN'T MAKE SENSE TO REQUIRE THAT AT THIS POINT, BECAUSE IT'S FEBRUARY, IT'S END OF THE MONTH, THAT THEY WOULD BE ABLE TO GIVE THE SAME DOWN WITH BREAKERS.

THAT'S IF THE BREAKERS WILL SHOW UP.
